Bee & Bear Boutique Lodge Rental Agreement

1. Rental Venue

1.1 Bee & Bear Boutique Lodge (hereinafter referred to as the "Venue Owner") agrees to rent the Bee & Bear Boutique Lodge retreat venue and the contiguous acres, situated at 3203 Range Road 300, Twin Butte, Alberta, to the Client. The Client commits to ensuring that all activities and uses on-site align with the approved uses as indicated in Appendix A (attached).

2. Property Details and Inventory

2.1 The Client acknowledges the provision of a Property Inventory Sheet, appended as Appendix B, which comprehensively enumerates the furniture and appliances within the property, in addition to their present condition.

2.2 By confirming a booking with Bee & Bear Boutique Lodge, the Client undertakes the responsibility for the property and its contents throughout the rental period, ensuring the prevention of any damage. Furthermore, the Client accepts financial accountability for any damage that does occur.

3. Guest Data

3.1 Upon booking, the Client shall furnish the subsequent personal data for all guests residing at the property:

   - First and last name

   - Email

   - Phone number

   - Home address

   - Credit card information for retention purposes

In turn, Bee & Bear Boutique Lodge commits to complying with the provided Privacy Policy, ensuring the secure and responsible use and storage of the Client’s personal information.

4. Capacity Limits

4.1 The property's maximum capacity is capped at 8 persons. The Client acknowledges and consents to adhere to these capacity restrictions.

4.2 In compliance with local regulations, the Client understands that surpassing the maximum capacity may lead to penalties, with the Client assuming responsibility for any such transgressions.

5. Check-In and Check-Out Times

5.1 To maintain a tranquil and considerate environment for all, the Client agrees to adhere to the prescribed check-in and check-out times, unless otherwise communicated and agreed upon between the parties in this agreement.

- Check In: 3 pm on the day of arrival

- Check Out: 11 am on the day of departure

5.2 Failure to vacate the premises on time will incur a penalty fee of $100 per hour after 3 pm.

6. Minimum and Maximum Stay Requirements

6.1 The Client acknowledges and accepts the stipulated minimum stay requirement of 2 nights. In the event that the Client's stay falls short of the requisite duration, irrespective of the reason, the Client acknowledges the obligation to remit the full price of the minimum stay or the mutually agreed-upon length of stay, whichever is higher.

7. House Rules

7.1 The Client is expected to abide by all house rules furnished by the Venue Owner, designed to ensure a harmonious and respectful environment for all guests.

7.2 All doors and windows must be closed and latched whenever leaving the property unattended. Please pay particular attention to the mid and lower level double doors leading to the deck/ground entry. 

8. Prices and Fees

8.1 The entire price and rental fee are to be conspicuously disclosed within the booking quote, encompassing all applicable taxes and fees.

8.2 A security deposit, set at a minimum of 25% of the total rental cost, is obligatory for all rentals. Bee & Bear Boutique Lodge reserves the prerogative to adjust this deposit as it deems necessary.

9. Accepted Payment Methods

9.1 All major credit cards are acknowledged as valid forms of payment. Alternative payment arrangements may be accommodated upon request.

10. Payment Schedule and Cancellation Policy

10.1 Unless otherwise outlined and agreed upon in writing, the payment schedule and cancellation policy as follows. 

• 50% due at the time of booking. Remaining balance due 1 day before arrival.

• 100% of paid prepayments refundable when canceled 60 days before arrival or earlier. 

• 50% of paid prepayments refundable when canceled 30 days before arrival or earlier. 

• 0% refundable if canceled after.

• A pre-authorization of 50% is held 0 days before arrival and voided 3 days after departure.

• All payments are to be made via credit card. Other arrangements can be facilitated upon request.

11. Liability Waiver

11.1 The Client unequivocally waives any potential liability stemming from any source or reason arising from Bee & Bear Boutique Lodge and all affiliated individuals and partners.

12. Wildlife and Livestock

12.1 The Client acknowledges the location of Bee & Bear Boutique Lodge within a remote and natural setting, where encounters with wildlife and livestock are to be expected. The Client assumes complete responsibility for any such interactions.

13. Insurance

13.1 Bee & Bear Boutique Lodge strongly recommends, and the Client agrees, that the Client should procure their own 3rd party trip insurance as required.

It is the Client’s responsibility to diligently peruse and comprehend the terms and conditions articulated in this Agreement before finalizing a booking. By consummating a booking with Bee and Bear Boutique Lodge, the Client acknowledges acceptance of this Rental Agreement. We strongly recommend seeking legal counsel to scrutinize and tailor this Agreement to fulfill your precise requirements and comply with Alberta's governing laws and regulations.

Appendix A: Permitted Activities on Bee & Bear Boutique Lodge Retreat Venue

This document serves as an annex to the Bee & Bear Boutique Lodge Rental Agreement and outlines the activities and regulations for guests during their stay at the retreat venue. Please read and abide by these guidelines to ensure a peaceful and enjoyable experience for all.

Permitted Activities:

1. Quiet Retreat: Bee & Bear Boutique Lodge is designed for quiet retreats, relaxation, and small gatherings focused on nature and tranquility.

2. Nature Exploration: Guests are encouraged to explore the natural surroundings, enjoy scenic walks, and appreciate the local flora and fauna. Please respect the environment, wildlife, and livestock on the property, and be sure to remain within the property boundaries as indicated by the barbed wire fence or other clear boundary. 

3. Designated Firepit Areas: Campfires are only permitted in designated firepit areas. Guests must follow fire safety guidelines and not create open flames outside of these designated areas. They must also abide by local fire restrictions in effect at any given time.

4. No Parties: Parties and large gatherings are strictly prohibited. Bee & Bear Boutique Lodge is intended for a serene and peaceful atmosphere in the interest of our guests, neighbors, wildlife and community.

5. Maximum Overnight Guests: The property has a maximum occupancy limit of 8 persons for overnight stays. All individuals must be registered guests of the primary Client.

6. No Pets: Pets are not allowed on the premises to maintain a safe, clean and comfortable environment for all guests. Service animals with proper documentation are an exception and must be disclosed in advance.

7. No Smoking: Smoking, including the use of electronic cigarettes, is prohibited inside any building on the property. If smoking outdoors, the Client MUST dispose of cigarette butts responsibly and be aware of fire risks. 

8. Noise Control: Guests are expected to keep noise levels to a minimum at all times, especially during quiet hours between 10:00 PM and 7:00 AM.

Additional Considerations:

1. Animal Interaction: While exploring the natural surroundings, exercise caution and avoid close encounters with wildlife, livestock or other animals at large. Do not feed or disturb animals.

2. Trash Disposal: Dispose of trash and recyclables in the provided bins. Overflow is to be be stored in additional trash receptacles to be found in the adjacent shop for extended storage to ensure safety to persons and wildlife.  

3. Safety: Familiarize yourself with the property's layout, emergency procedures, and safety equipment locations. In case of emergencies, the rural address is 3213, MD of Pincher Creek, to be provided to 9-1-1.

4. Respect for Nature: Help us preserve the natural beauty of the area by refraining from littering and respecting local flora and fauna.

5. Guest Responsibility: As outlined in the Rental Agreement, the Client is responsible for the property and its contents during their stay. Any damage to the property or its belongings is the fiscal responsibility of the Client.

6. Alcohol Use: The Bee & Bear Boutique Lodge does not carry an alcohol service license. Alcohol use is at the discretion of the Client. Please ensure that alcohol is consumed in a responsible and respectful manner, in accordance with all applicable laws and regulations, and that guests of legal drinking age are aware of their responsibilities while consuming alcoholic beverages on the property.

By accepting the Bee & Bear Boutique Lodge Rental Agreement, you acknowledge your understanding and commitment to these guidelines. Failure to comply with these regulations may result in penalties, including fines or eviction from the property.
